Under the Fair Debt Collection Practices Act (FDCPA), debtors are protected from unlawful harassment from debt collectors. In fact, individuals who sue harassing creditors may secure up to $1, 000 per successful lawsuit under the FDCPA. The FDCPA specifies that debt collectors may not harass or abuse debtors, such as by threatening violence or harm, using obscene or profane language, insulting them, calling repeatedly, bothering debtors during unreasonable times (e.g., early morning or after midnight), threatening the loss of child custody or welfare benefits, or contacting their employer without permission. Collectors are prohibited from lying or making false statements to collect a debt. For instance, they cannot falsely claim they are government representatives or attorneys, that the debtor has done something illegal when they have not, or that they work for a credit reporting agency (such as by providing a fake company name). It is also illegal for collectors to tell debtors a false amount of debt that they claim they owe or send fake government documents they claim are legal. A creditor may not tell a debtor that they will be arrested for not paying, and they cannot garnish wages or take the debtor’s property unless they have obtained a court order or intend to take legal action. They also may not misrepresent or misinform a debtor’s credit report.

The FDCPA was written to prevent debt collectors from harassing consumers. One of the provisions of the FDCPA is that debt collection agencies are not allowed to call folks at times and places that are inconvenient to them. Our client says that ERC called her between 8:00 a.m. 5:00 p.m. When our client answered the phone call, she told the debt collector from ERC to only contact her after 6:00 p.m. She also said that she was unable to take any calls before 6:00 p.m. Nevertheless, ERC continued to call her before 6:00 p.m. May 24, 2017. On behalf of our client, Lemberg Law recently filed a complaint in U.S. District Court, Middle District of Florida. The case, against Enhanced Recovery Company, charges the debt collection agency with violating federal law and asks for $1, 000 in statutory damages under the Fair Debt Collection Practices Act and other relief. No one likes getting debt collection calls.

I googled it. Came across your page. I watched your video. I keep getting harassing phone calls from ERC. They want me to confirm personal information such as address, phone number, etc. I ask what the call is about and they tell me it’s a personal matter that I have to confirm my info before they proceed to tell me what they are calling for. I have multiple calls from them on my phone. I have asked them to stop calling but they won’t stop. I get robo calls from them where I will answer. It will be a automated operator asking me to please hold for next available representative. It’s very frustrating because I don’t even know why they are calling. Is this legal for them to do this? Enhanced recovery keep calling me. I spoke to a member of your law office about this last month.

On a later call the caller asked to verify my name without identifying that they were from ERC. They told me they were from ERC after I asked them to identify themself. I asked them to call me on my other number instead on which we had a conversation. During today’s call I did arrive at a settlement with them for the debt they were calling about. Also during this call I did give permission to receive their automated calls to my land line in the future if needed. I didn’t realize that there was a telephone harassment law until I looked up ERC and saw your website. Thank you for your advocacy. I am being harrassed by this company daily. I asked ERC how to file a cease and desist from phone calls and was hung up on twice. I signed up for AT & T Internet service for my law office. About a month later, there was a tragic arson fire that made the office uninhabitable. The Internet service was of no use. I canceled. Over a year later, I started to get demands for payment on the account. I even made a small payment to AFNI.
